Page No.# 2/3 BEFORE HONOURABLE MRS. JUSTICE SUSMITA PHUKAN KHAUND ORDER 06.05.2026 Heard Mr. U. Choudhury, learned counsel for the petitioner and learned Amicus Curiae, Ms. T. Parasar, is present for the respondent no.2. Also heard Mr. B. Sharma, learned Additional Public Prosecutor for the State. 2. This application has been filed under Section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the petitioner namely, Lachit Ray, who is stated to have been in custody since 21.06.2025, has prayed for bail in connection with Special (POCSO) Case No. 65/2025 under Section 75(1) of BNS, 2023, R/W Section 8 of POCSO Act arising out of Kokrajhar P.S. Case No.149/2025, pending in the Court of Special Judge (POCSO), Kokrajhar. 3. It is submitted on behalf of the petitioner that his right to personal liberty has been curtailed. 4. The learned Amicus Curiae has submitted that the respondent no.2 has no objection, if the petitioner is enlarged on bail. 5. I have considered the submission that the petitioner is willing to cooperate with the trial. It is also submitted that the petitioner is not a flight risk, as he is a local resident. The petitioner is willing to abide by any stringent bail conditions, if imposed upon him. 6.
Considering the entire aspect of the matter, the above-named petitioner is allowed to go on bail of Rs.25,000/- (Rupees Twenty Five
Page No.# 3/3 Thousand) only with one surety of like amount subject to the satisfaction of the learned trial court with following conditions: (i) That the petitioner shall not exercise threats to the witnesses; (ii) That the petitioner shall not be anywhere in the vicinity of the victim or attempt to contact her, till the completion of the trial; (iii) That the petitioner shall cooperate with the trial and shall not leave the jurisdiction of the Court without prior permission, till completion of trial. 7. On breach of any of the bail conditions, bail order shall stand cancelled. 8. Accordingly, the bail application stands disposed of. JUDGE
