Heard learned counsel for the applicant and learned counsel for the State. 2. The applicant, who is in custody since 17.09.2025, has approached this Court for grant of regular bail in connection with Nagar Untari P.S Case No.61 of 2006, registered for the offence under Sections 25(1-B)(a)/ 26 of the Arms Act. 3. Having heard learned counsel for the parties and from perusal of record, it appears that it is a case of misuse of the privilege of bail. This applicant has been granted bail by the trial court itself, but he has jumped the bail in the year 2009 and thereafter, he has been apprehended on 17.09.2025. There is unexplained misuse of bail for about 15 years and on that ground the trial court has rightly rejected the prayer for bail of the applicant. 4. Now, considering the fact that the applicant has shown his willingness to participate in the trial and he has remained in custody for more than three months, I am inclined to enlarge the applicant on bail. Accordingly, the applicant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Nagar Untari, Garhwa, in connection with Nagar Untari P.S Case No.61 of 2006, on the condition that one of the bailors will be the pairvikar of this case and the sureties will be the landed property of the family of this applicant and the applicant will - 1 - B.A. No.11468 of 2025 2026:JHHC:4934 submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned trial court which he will always keep active and will not change it during pendency of this case without prior permission of the court .
