ORDER : The Court made the following order :- The petitioner /Accused No.1, who was arrested and remanded to judicial custody on 08.07.2026, for the offences punishable under Sections 109, 296(b) and 351(3) @ Sections 109(1), 296(b) and 351(3) of BNS, 2023, in Crime No.491 of 2026, on the file of the respondent police, seeks bail. 2. The allegation against the petitioner is that due to money dispute, the petitioner joining hands with the other accused attempted to attack the defacto complainant with knife. However, there was no injury caused to the defacto complainant. Hence, the present case has been registered and the petitioner has been arrested. 3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He would further submit that no one sustained any injuries in this case. He is in custody from 08.07.2026 and ready to cooperate with the investigation. 4. The learned Counsel for the State of TN (Crl. Side) appearing for the respondent Police reiterated the prosecution case and reported that the petitioner has two previous cases. Investigation is still pending. No one sustained any injuries in this case. However, he opposed the grant of bail to the petitioner. 5. This Court heard both sides and perused the materials available on record. 6. Considering the facts and circumstances of the case and also the fact that no one sustained any injuries in this case and though the petitioner has two previous cases, considering the period of incarceration, I am inclined to grant bail to the petitioner subject to certain conditions. [a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial 3/6 https://www.mhc.tn.gov.in/judis
