Date : 06.05.2026. Page No.# 2/3 Heard Mr. G. Chamuah, learned counsel for the accused petitioner. Also heard Mr. P. Borthakur, learned Addl. P.P., Assam appearing on behalf of the respondent State. This is an application under Section 482 of BNSS, 2023 praying for grant of pre- arrest bail to the accused/petitioner, namely, Shohid Ali @ Chahid Ali, who is apprehending arrest in connection with the Manikpur P.S. Case No. 119/2025, registered under Sections 329(4)/64(1) of the BNS, 2023. The scanned copy of the TCR along with the case diary is received and perused the same. It is submitted by Mr. Chamuah, the learned counsel for the accused petitioner that during the pendency of the present petition, the I.O. has submitted the charge sheet in the present case. However, after obtaining the order of interim pre-arrest bail, the petitioner appeared before the I.O. and extended his cooperation. The learned counsel further submitted that as the case is Sessions triable, the petitioner may be allowed to remain on previous interim bail till the case is committed before the learned Sessions Judge. Mr. Borthakur, the learned Addl. P.P., Assam submitted in this regard that the statement made by the victim as well as her daughter implicates the present petitioner and at the same time, the petitioner is shown as the absconder in the charge sheet. However, it is submitted by Mr. Borthakur that the petitioner had got the interim order on 20.01.2026 and the charge sheet was filed on 07.01.2026, i.e. prior to the order of interim pre-arrest bail. Considering the submissions made by learned counsel for both sides, I have

It is the admitted fact that the charge sheet was filed prior to the order of interim pre-arrest bail, for which the accused petitioner is shown as absconder. Thus, the statement of the present petitioner is also not available in the case diary though it is submitted by Mr. Chamuah, the learned counsel for the accused petitioner that the accused petitioner appeared before the I.O. after obtaining the order or interim pre-arrest bail. Considering all these aspects of the case, the petitioner is hereby directed to appear before the learned Trial Court below with an appropriate application for regular bail. However, till the case is committed before the learned Sessions Judge, the interim order granted earlier to the present petitioner will remain in force. Further, the learned Committal Court/Trial Court is hereby asked to make all the necessary endeavor to send the case record before the learned Sessions Judge within the reasonable period of time.
