SECOND APPEAL ST. NO. 645 OF 2026
1. The 7appellant is the original petitioner. He had filed a petition for divorce on the grounds of desertion and Kavita
2 / 2 1.cas 1138-26 cruelty. The said petition came to be dismissed by the learned Trial Court.
2. Aggrieved by the said judgment and order, the appellant preferred an appeal, which was also dismissed. Hence, the appellant has preferred the present Second Appeal on the following proposed substantial questions of law: a. Whether the Learned Trial Court and Learned First Appellate Court erred by failing to consider the issue of irretrievable breakdown of marriage and to give any observations over the same? b. Whether the Learned Trial Court and Learned First Appellate Court erred by failing to give any observations and pass a Decree of Divorce over the admission of the respondent of long and continuous separation?
3. Issue notice to the respondent on the above mentioned substantial question of law, returnable on 29/09/2026.
