JUSTICE SAMEER JAIN Order 28/03/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 61/2026 registered at Police Station Sarwar District Ajmer for the offence(s) under Sections 8/15 of NDPS Act and the learned Trial Court amidst the offences under Sections 8/15, 25 of NDPS Act dismissed the bail application before it. 2. Learned counsel for the applicant has submitted that the applicant is sole bread earner of the family, aged about 56 years. It is submitted that the quantity recovered is 21.470 Kgs of poppy straw which is less than the commercial quantity i.e. 50 Kgs. It is submitted that similar antecedents are not portrayed qua the applicant. It is also submitted that the applicant is ready to co- operate in the investigation. Having heard the contentions made by the counsel representing both the parties, upon a perusal of the material available on record and taking note of the fact that the applicant is sole bread earner of the family, aged about 56 years; that the quantity recovered is 21.470 Kgs which is less than the commercial quantity; that similar antecedents are not portrayed qua the applicant, this Court is inclined to enlarge the accused- applicant on bail. 5. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Hariram S/o Kamad shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
