Present criminal jail appeal has been preferred against the judgment and order dated 19.01.2023 passed by the learned Fast Track Special Court/ Additional Sessions Judge, Dehradun, in Special Sessions Trial No. 146 of 2018, arising out of Case Crime No. 233 of 2018, Police Station Doiwala, District Dehradun, whereby the appellant was convicted for the offences punishable under Section 354 IPC and Section 8 of the POCSO Act. The appellant was sentenced to undergo rigorous imprisonment for four years along with fine, with default stipulation of 6 months, and the period already undergone was directed to be adjusted.

Learned counsel for the appellant submits that the appellant has already undergone the substantive sentence awarded to him, which stood completed on
14.11.2025. It is further submitted that, since the fine amount was not deposited, the appellant was required to undergo the default sentence also, which too stood completed on 14.05.2026.
5. Learned State counsel does not dispute the aforesaid factual position.
6. In view of the fact that the appellant has already undergone the sentence awarded to him as well as the default sentence,
learned counsel for the appellant submits that he be released forthwith.
7. Accordingly, the Criminal Jail Appeal is dismissed as infructuous.
