2. Mr. Chitrarth Kandpal, learned Brief Holder for the State.
3. Present bail application is moved by the applicant, who is in judicial custody in connection with FIR No.0088 of 2026 under Section 351(3) and 69 of BNS, Police Station Vikasnagar, District Dehradun.

Learned counsel for the applicant submits that there is allegation that time and again applicant had made physical relationship with the complainant on the false pretext of marriage but complainant has not lodged the FIR prior to that point of time. He submits that applicant and complainant before coming into contact were already married with another person.
5. Learned State counsel has opposed the bail application.
6. Having considered the submission of learned counsel for the parties and considering the overall
facts and circumstances of the case, this Court is of the view that applicant is entitled to be released on bail.
7. Accordingly, bail application is allowed. Let the applicant-Mohammad Shoyab be released on bail on his executing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned.
8. Pending application, if any, stands disposed of.
