ORDER The present petition has been filed by A1 to A3 in Spl.S.C.No.74 of 2025 on the file of the Special Court for Exclusive Trial of Cases under POCSO Act, Nagercoil, Kanniyakumari District, seeking to set aside the order passed in Crl.M.P.Nos.57 and 58 of 2026, wherein, the applications filed by the petitioners under Section 348 of BNSS have been rejected. 2.Perusal of the records reveal that the petitioners are charged with the offence under Sections 332(b), 64 of BNS Act, 2023 and Sections 6, 5(j)(ii) r/w 3(c) r/w 8 of POCSO Act, 2012. In the above said case, PW1 and PW2 were chief examined on 19.12.2025 and PW3 and PW4 were chief examined on

Immediately on the next date of hearing, viz., on 29.01.2026, applications have been filed seeking to recall PW1 to PW4 for the purpose of cross-examination. Those applications came to be dismissed by the trial Court relying upon Section 33(5) of POCSO Act. Challenging the same, this petition has been filed. 2/6 https://www.mhc.tn.gov.in/judis
