Mazumdar, learned senior counsel for the petitioner. None appears on behalf of the State. The petitioner is an accused in connection with Patharadda (O.P.) P.S. Case No.45 of 2025. It has been alleged that the daughter of the informant was subjected to rape by the petitioner and by one Mohan Kumar Das. Learned senior counsel for the petitioner has submitted that the petitioner is in custody since 15.09.2025. It has further been submitted that co-accused Mohan Kumar Das has been granted bail in Cr. Revision No.966 of 2025. It appears that in the statement of the victim recorded under Section 180 of BNSS it was stated about the petitioner and co-accused Mohan Kumar Das taking her to a field near the forest and committing rape upon her. The co-accused Mohan Kumar Das has been granted bail in Cr. Revision No.966 of 2025 primarily on account of the fact that he was a juvenile. So far as the petitioner is concerned, in view of the statement of the victim recorded under Section 180 of BNSS in which his specific role has been assigned, I am not inclined to grant bail to the petitioner.
