For Petitioner : Mr.M.Mohamed Zamil for M/s.Ajmal Associates For Respondents : Mr.D.Venkatesh Counsel for the State of Tamil Nadu (Crl. side) Page No.2 of 6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.3723 of 2026 O R D E R [Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] The writ petition has been filed seeking writ of Certiorarified Mandamus to call for the records relating to the impugned proceedings of the 3rd Respondent in No.1277/Tha.Ku.2/2026, dated 29.04.2026 and quash the same as illegal and consequentially directing the respondents to grant parole to the petitioner's husband namely, Bhagavathiraj (PID No. 511936) a Life Convict Prisoner, now confined in the Central Prison, Madurai without escort permitting him to execute his personal bond before the Prison Authorities. 2. When the matter is taken up for hearing today, Mr.D.Venkatesh, learned Counsel for the State of Tamil Nadu appearing for the respondents would submit that the petitioner's husband is a convict prisoner undergoing life sentence having been convicted on 09.12.2024 the petitioner had sought for grant of temporary parole to the convict prisoner to attend on his mother-in-law, who is ill. The Rules does not provide for grant of parole. The convict prisoner can either be granted ordinary leave Page No.3 of 6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.3723 of 2026 or emergency leave as per the Rules. As far as the convict prisoner is concerned, he has not completed 3 years, and further the Rules does not provide for grant of ordinary leave or emergency leave for attending on the mother-in-law, who is ill. 3. Recording the said submission, we do not find any infirmity in the order. Accordingly, this Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
