THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.19740 of 2025 O R D E R: The present Writ Petition is filed questioning the Charge Memorandum dated 28.03.2024 issued to the Petitioner vide C.No.14/OEPR/A8/2024 as illegal and arbitrary as the issue pertains to matrimonial dispute. 2. The Petitioner is working as A.R. Constable at Ongole. While so, a Criminal case was registered against the Petitioner in Cr.No.612 of 2021 on the file of Giddalur Police Station, at the instance of his wife. After the investigation, a Charge Sheet was filed by the Police before the Additional Judicial First Class Magistrate, Giddalur, for the offences punishable under Sections 323, 498-A r/w 34 IPC and Sections 3 and 4 of DP Act and the same was numbered as C.C.No.167 of 2021. After registration of the Criminal Case, a Departmental Enquiry was initiated whereunder the Article of Charge was that the Petitioner exhibited gross reprehensible misconduct of involvement in a Criminal case while working in DAR, Tirupathi and harassing the wife Smt G. Krishnaveni by suspecting her fidelity. 3. The list of documents and the statements of the individuals recorded during the course of investigation and the list of witnesses sought to be cited in the Departmental Enquiry are similar in the Criminal Case registered against the Petitioner. It is also stated that the wife of the Petitioner filed HMOP No.16 of 2025 seeking for divorce on account of willful desertion and the same was allowed by

the Senior Civil Judge, Darsi on 11.09.2025. It is also stated that C.C.No.167 of 2021 was referred to Lok Adalat at Giddalur and the Complainant and the Accused has resolved the disputes between them in the Lok Adalat conducted on 13.09.2025 vide L.A.No.292 of
2025.
It is stated that taking note of the divorce in HMOP No.16 of 2025 and Lok Adalat Award vide LA.No.292 of 2025, it would be futile to pursue the Departmental Enquiry against the Petitioner. 4. Learned Assistant Government Pleader for Services-II would submit that the Respondent Authorities will examine the case of the Petitioner taking note of the of the divorce in HMOP No.16 of 2025 and Lok Adalat Award vide LA.No.292 of 2025 and pass appropriate orders with regard to continuation of the Departmental Enquiry. 5. Heard the learned counsel. 6. The disputes between the Complainant and the Petitioner in C.C.No.167 of 2021 were resolved before the Lok Adalat on 13.09.2025 and an award was passed to that effect. A decree of divorce was also passed in HMOP No.16 of 2025. In view of the subsequent developments and taking into consideration that there is amicable settlement between the parties, the present Writ Petition is disposed of with the following directions:
i) The Respondents shall examine the requirement of further progress in the Departmental Enquiry in view of the divorce in HMOP No.16 of 2025 and Lok Adalat Award vide LA.No.292 of 2025 and pass appropriate orders on the Departmental Enquiry as expeditiously as possible, preferably within a period of (08) weeks from the date of receipt of a copy of this Order. 4
ii) There shall be no order as to costs. As a sequel, miscellaneous petitions, pending if any, shall stand closed. __________________ NYAPATHY VIJAY, J Date: 09.07.2026
