JUSTICE V.SRISHANANDA) 1. Heard Sri.Shreedhar Kottershetty, learned counsel appearing for petitioners, Smt.Kirtilata R. Patil, learned High Court Government Pleader, appearing for respondent No.1-State and Sri.S.F.Kusalapur, learned counsel appearing for respondent No.2. 2. The petitioners/accused have filed the present petition with following relief: “To quash FIR in Crime No.61/2025 Katkol P.S. pending on the file of Civil Judge and JMFC at Ramadurga for the alleged offences punishable u/s- 189(2), 191(2), 191(3), 126(2), 115(2), 118(1), 352, 351(2), r/w.190 of BNS, before petitioners/a1 to a8.” 3. The Parties are present before the Court along with their respective counsel. They have filed an application seeking compounding of the offences, supported by the affidavits of the injured/complainant. - 4 - HC-KAR NC: 2026:KHC-D:2036 CRL.P No. 100065 of 2026 4. On enquiry, the parties submit that they have agreed to settle the dispute amicably, which occurred on the spur of the moment, and that they do not want to continue with both the criminal proceedings in order to maintain peace and tranquility at the family-home front. 5. The compromise entered into between the parties appears to be voluntary, and this Court is satisfied to dispose of the matter in terms of the compromise. 6. It appears that a trivial incident was blown out of proportion, resulting in the filing of the complaint and counter-complaint. In one case, the charge sheet has been filed, whereas in the other, the investigation is still pending. 7. Taking note of the true settlement arrived at between the parties, and though the offences alleged are non-bailable in nature, following the principles laid down by the Hon’ble Supreme Court in Ramgopal and Another vs. State of Madhya Pradesh1, this Court is of the view that the application seeking compounding is allowed and the pending proceedings are liable to be quashed 1 (2022) 14 SCC 531 - 5 - HC-KAR NC: 2026:KHC-D:2036 CRL.P No. 100065 of 2026 8. Accordingly, the following order: ORDER (i) The petition and the applications are allowed. (ii) Consequently, the FIR in Crime No.61/2025 registered by Katkol Police Station, pending on the file of Civil Judge and JMFC, Ramdurg, insofar as the petitioners/accused Nos.1 to 8 are concerned, stands quashed.
