Gurung, learned GA has submitted at the bar that on strict instruction, it is learned that the petitioner/accused person herein has been issued notice under Section 35(3) BNSS requiring him to appear before the Investigating Officer (IO) which he has done so accordingly. There is also interim direction by this Court compelling him to appear before the said IO which was also fulfilled. 2. The learned GA has further submitted that there is no requirement of imminent arrest of the petitioner at this point of time. 3. Accordingly, in the light of such submission, this petition has become infructuous. 4. Interim order passed is discharged. 5. Petition disposed of.
