2. The case of the prosecution is that the defacto complainant is running a hotel and it is alleged that petitioner along with other accused consumed food and failed to make payment. When the defacto complainant demanded the payment, the petitioner abused him in a filthy language and also threw the broken beer bottles inside and outside the hotel causing danger and nuisance to the public. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that no previous case is pending against this petitioner. However, she opposed to grant anticipatory bail to the petitioner.
5. I have given my anxious consideration to either side submissions and perused the materials available on record. https://www.mhc.tn.gov.in/judis

6. Considering the facts and circumstances of the case, from the
submissions made by learned Government Advocate (Crl.Side), it is seen that petitioner has no criminal antecedents and the allegation against this petitioner is that he consumed food and failed to make payment besides assaulted the hotel employee in black and blue brutally. Considering the seriousness of the allegation and the conduct of the petitioner, if the petitioner is enlarged on anticipatory bail, he may be emboldened to indulge in similar offences in future without fear of law. Hence, taking into consideration of interest of the society at large, this Court is not inclined to enlarge the petitioner on anticipatory bail.
7. Accordingly, this Criminal Original Petition is dismissed. 14-07-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No NR To:
