THIS PETITION COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: THE HON'BLE MR. JUSTICE M.I.ARUN AND THE HON'BLE MR. JUSTICE B. MURALIDHARA PAI - 3 - HC-KAR NC: 2026:KHC-D:108-DB WP No. 110000 of 2025 ORAL ORDER (PER: THE HON'BLE MR. JUSTICE M.I.ARUN) Respondent No.4 was posted as a Revenue Inspector in Chabbi Hobali, Hubballi Taluka. He was transferred from the said post and no posting was given to him and in his place the petitioner herein was posted. Aggrieved by the same, respondent No.4 herein preferred Application No.11049/2025 before the Karnataka State Administrative Tribunal (for short, ‘the KSAT’) on the ground that his transfer is premature and that he has not been shown any posting. The said application came to be allowed and the order of his transfer came to be quashed. 2. The present petition is filed by the petitioner, who was respondent No.4 before the KSAT. The case of the petitioner herein is that presently the minimum guaranteed tenure of 4 years in favour of the 4th respondent shall expire on 01.02.2026. It is further submitted that presently he has taken charge as Revenue - 4 - HC-KAR NC: 2026:KHC-D:108-DB WP No. 110000 of 2025 Inspector in place of respondent No.4. However, he is not in a position to show what is the error in the impugned order passed by the KSAT. 3. The learned counsel for respondent No.4 admits that respondent No.4 will complete 4 years as on 01.02.2026 and that he can be transferred thereafter from the said post. However, he submits that respondent No.4 is entitled to continue as a Revenue Inspector of Chabbi Hobali, Hubballi Taluka, till fresh orders of transfer have been issued to him. He justifies the order passed by the KSAT and prays for dismissal of the writ petition. 4. The learned AGA appearing for respondents No.1 to 3/State upon instructions submits that the State will obey the orders passed by the KSAT and will give necessary posting to both the petitioner as well as respondent No.4, immediately after 01.02.2026. 5. Under the circumstances, we do not see any error in the impugned order and it does not call for any - 5 - HC-KAR NC: 2026:KHC-D:108-DB WP No. 110000 of 2025 interference at the hands of this Court. However, taking into consideration the peculiar facts and circumstances of the case, we deem it appropriate to direct the State to give effect to the transfer order made infavour of the petitioner after 01.02.2026 and to give necessary posting to respondent No.4 immediately thereafter. Writ petition stands disposed accordingly. Sd/- (M.I.ARUN) JUDGE Sd/- (B. MURALIDHARA PAI) JUDGE CKK CT:BCK LIST NO.: 1 SL NO.: 24
