(2) Petitioner claims to be Secretary of erstwhile Managing Committee of Waqf Board No. 454, Eidgah, Jwalapur, Haridwar. According to petitioner, the said waqf committee was constituted by Uttarakhand Waqf Board vide order dated 2.3.2019 for a term of three years and thereafter the affairs of the said waqf was being looked after by the aforesaid committee, however, now a fresh waqf committee has been constituted by Uttarakhand Waqf Board vide order dated 21.2.2025, without affording any opportunity of hearing to the Managing Committee or the Wakf Board. In this writ petition, petitioner has challenged the order dated 21.2.2025, passed by Uttarakhand Waqf Board, whereby new committee of the aforesaid waqf has been constituted. (3) Mr. T.A. Khan, learned Senior Counsel appearing for Uttarakhand Waqf Board, submits that the issue raised by the petitioner in this writ petition can only be decided by Waqf Tribunal, constituted under Section 83 of Waqf Act, 1995. He further points out that petitioner, in fact, has approached the Waqf Tribunal and the petition filed by the petitioner is pending before the Waqf Tribunal. (4) Since petitioner has approached 2026:UHC:184 the appropriate forum available under the statute, therefore, this Court is not inclined to entertain the writ petition. Writ petition is, accordingly, dismissed on the ground of alternate remedy with liberty to petitioner to seek his remedy in the pending waqf petition. (5) Interim order, if any, stands vacated.
