Union of India reported in (1991) 3 SCC 47 and State of Orissa & Anr. Vs. Raj Kishore Nanda & Ors. reported in (2010) 6 SCC 777. Learned counsel is also not able to refute the fact that in the instant matter, there is no vacancy left and future recruitment process has already been completed.
