For the State : Mr. Pankaj Kumar Mishra, A.P.P. ------ 05/ 17.03.2026 Heard learned counsel appearing for the petitioners and learned A.P.P for the State. 2. The petitioners are apprehending their arrest in connection with Tisra P.S. Case No. 10 of 2025, registered for the offence under [2026:JHHC:7239] -2- Sections 191(2), 191(3), 190, 132, 121, 61(2), 326, 324, 115(2) and 117(2) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Dhanbad. 3. Learned counsel appearing for the petitioners submits that it has been alleged that 25-27 named villagers and 100-150 unknown persons came to Devprabha Mining and Infra Pvt. Ltd. and made hooliganism and certain property has been put on fire. He next submits that the petitioners were agitating with regard to raiyati land, upon which, illegally mining debris was being dumped. He further submits that for the same allegations, another FIR, being Tisra P.S. Case No. 12 of 2025 has been lodged by outsourcing company, in which, the petitioner and other co-accused persons have already been provided the privilege of anticipatory bail in A.B.A. No. 922 of 2026 by this court and the present case has been lodged by the police official for the same occurrence. 4. Learned A.P.P appearing for the State has opposed the prayer and submits that the allegations are there of making hooliganism. 5. On perusal of the FIR, it is apparent that there is allegation against 25-27 named and 100-150 unknown persons of indulging in such hooliganism and further there are general and omnibus allegations against all the accused persons and the petitioners are said to be the raiyats, where the Devprabha Mining and Infra Pvt. Ltd. was dumping the mining debris on their raiyati land, for that the agitation was going on and for the same occurrence, two FIRs have been registered and in one of the FIR, lodged by the outsourcing company, the petitioner and other co-accused persons have already been provided the privilege of anticipatory bail in the aforementioned A.B.A. In that view of the [2026:JHHC:7239] -3- matter, the petitioners, named above, are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
