Order This Writ Petition has been filed seeking a direction to the second respondent to dispose of the petitioner’s Application dated 09.06.2026, wherein the petitioner has raised objections against registering any document submitted by the fourth respondent. 2. The learned counsel for the petitioner submitted that the petitioner entered into a Sale Agreement on 22.03.2022 to purchase the property situated in S.F. Nos. 249/1 and 250/2, measuring an extent of 0.99.00 hectares in Chikkalur Village, Harur Taluk, Dharmapuri District, from the vendors, V. Annadurai and two others, for a total sale consideration of Rs. 10,60,000/-. At the time of execution, the vendors handed over the original Partition Deed dated 09.09.2019, and the petitioner has paid a sum of Rs. 6,50,000/- to date. It is alleged that the vendors are now attempting to obtain a "Non-Traceable Certificate" to fraudulently sell the property to third parties without producing the original Partition Deed. Consequently, the petitioner lodged a criminal complaint, submitted a written representation dated 29.05.2026 to the official respondents, filed an objection application before the second respondent on 09.06.2026, and also initiated civil proceedings for the specific performance of the contract. WP No. 26948 of 2026 __________ Page3 of 5 deeds without insisting on the original parent documents. Aggrieved by the same, the petitioner has preferred this Writ Petition. 3. Mr. M. Roshan Atiq, learned Government Counsel, accepts notice on behalf of respondents 1 and 2. He submitted that following the striking down of Section 34-C of the Registration Act, registering authorities cannot refuse registration solely on the ground that the original parent documents are missing. He further submitted that since the provision has been declared unconstitutional, third-party objections under that section cannot be automatically maintained. However, he assured that if any document is presented for registration by the fourth respondent, a formal notice will be issued to the petitioner. After providing an opportunity of hearing to the petitioner, the document will be processed in accordance with law. 4. Heard both sides and perused the materials available on record. Since no adverse orders are being passed against the fourth respondent, notice to the fourth respondent is dispensed with. 5. This Court finds merit in the submissions advanced by the learned Government Counsel appearing for the official respondents.
Consequent to the invalidation of Section 34-C of the Registration Act by this Court, the registering authority is no longer empowered to refuse the registration of a https://www.mhc.tn.gov.in/judis

Therefore, it is directed that if any document is presented by the fourth respondent for registration affecting the subject property, the official respondent shall issue a formal notice to the petitioner, hear their objections, and thereafter proceed to pass appropriate orders on registration in accordance with law. 6.
