2. The prosecution case is that since 2023, the accused A1 And A2 induced the victims to avail the Tamil Nadu Housing Board scheme for below poverty people and cheated to a tune of Rs.3 Crores. It is the allegation against this petitioner A3 is that he impersonating as Housing Board staff, along with A4 had received a sum of Rs. 46,00,000/- from 46 persons. Hence, the case. 3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and they are willing to cooperate with the investigation. Hence, he prayed for grant of anticipatory bail. 4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the case of the prosecution and vehemently opposed the grant of anticipatory bail to the petitioner submitted that one previous case as against this petitioner. 5. This Court has considered the submissions made on either side. 6.
From the submissions of the learned Government Advocate (Criminal Side), it is seen that the petitioner is alleged to have impersonated a Housing Board staff member and, along with another accused, received a sum of __________ Page2 of 4 https://www.mhc.tn.gov.in/judis
CRL OP No. 18941 of 2026 Rs.46,00,000/- from 46 persons under the guise of securing allotments under the Tamil Nadu Housing Board scheme. The allegations disclose a well-planned act of cheating involving a large number of victims and huge monetary loss. It is also brought to the notice of this Court that one previous criminal case is pending against the petitioner. Considering the gravity of the allegations, the magnitude of the fraud, and the requirement of custodial interrogation to trace the money trail and ascertain the involvement of the other accused persons, this Court is not inclined to grant the discretionary relief of anticipatory bail to the petitioner. 7.
