For Petitioner: Mr.Neshapriyan M For Respondents: Mr.R.Ganesh Kumar Counsel for Government of Tamil Nadu (Criminal Side) for R1 to R3 ORDER This Writ Petition (Criminal) has been filed seeking a direction to the respondents 1 to 3 to provide adequate police protection and necessary assistance to the petitioner to take peaceful physical possession of the secured assets, in accordance with the order dated 02.02.2026 passed in Crl.M.P.No.6190 of 2025 by the Chief Judicial Magistrate, Tiruvallur. https://www.mhc.tn.gov.in/judis WP Crl. Heard the learned counsel appearing for the petitioner and the learned Counsel for Government of Tamil Nadu (Criminal Side) appearing for the respondents 1 to 3 and perused the materials available on record. 3. The petitioner had lend money to the respondents 4 to 6 herein. Subsequently, they have committed default in repayment and a sum of Rs.48,11,441/- became due and payable to the petitioner. Consequently, the petitioner initiated proceedings under the SARFAESI Act against the secured assets. In order to take physical possession of the secured assets, the petitioner filed an application under Section 14(1) of the SARFAESI Act in Crl.M.P.No.6190 of 2025 before the Chief Judicial Magistrate, Tiruvallur. By order dated 02.02.2026, the Chief Judicial Magistrate, Tiruvallur, allowed the application and appointed an Advocate Commissioner to take physical possession of the secured assets from the borrowers and guarantors. However, despite the Judicial order and the request made by the learned Advocate Commissioner, the respondents police failed to provide necessary police protection. 4. In view of the above, the first respondent is directed to provide adequate police protection to the Advocate Commissioner for taking physical possession of the secured assets, in accordance with the order dated 02.02.2026 https://www.mhc.tn.gov.in/judis WP Crl.
