The condition that is sought to be modified is that the two sureties ordered by the Trial Court must be the parents. 3. The learned counsel for the petitioner would submit that the petitioner’s father is not available at the address, and his mother alone is available in Jammu and Kashmir. Therefore, it is difficult to provide the sureties. He further submits that the same can be modified to two local sureties. 4. Considering that the petitioner is 26 years old and his involvement is in a case relating to 17 grams of ganja, the Trial Court imposed this condition keeping in mind the well-being of the petitioner himself. Therefore, I am not inclined to modify the condition entirely. 5. However, since it is stated that the father is unavailable, the mother shall come and provide the surety. If the mother comes and stands as surety, no local documents, such as solvency certificate etc., shall be insisted upon. Upon production of her Aadhaar Card, the mother's surety shall be accepted. 6. As far as the petitioner’s father is concerned, the petitioner’s mother shall file an affidavit stating that he is not available. In his place, one local surety for a sum of Rs.10,000/- shall be produced, which shall be accepted by the Trial Court. https://www.mhc.tn.gov.in/judis CRL OP No. 18538 of 2026 __________ Page3 of 4 7. The order dated 17.06.2026 is modified to the above effect.
