The case of the prosecution is that all these accused, who are the office bearers and employees of the co-operative society, have falsified the accounts, given loans in fictitious names, and misappropriated the amounts belonging to the co-operative society. It is submitted that the occurrence is of the year 2011 and that some of the accused have also died. The matter is also pending before the Hon'ble Supreme Court of India with reference to the discharge application filed by A6. 3. As far as the present petitioner is concerned, Mr.K.Prem Kumar, the learned counsel appearing on behalf of the petitioner, would submit that, when conspiracy is alleged to cheat the co-operative society, as on the date of the alleged conspiracy, the petitioner was not even the Special Officer. The only allegation made against him is that he signed one of the cheques with reference to the loan that was granted. 4. Per contra, the learned Government Advocate (Criminal Side) would submit that not only was the loan itself granted in favour of a fictitious person. 5. It may be true that the petitioner was not the Special Officer at the time of the alleged conspiracy. However, it is the case of the prosecution that he had signed the cheque by which the loan was disbursed in the name of a fictitious person. As a Special Officer, whether he was duty-bound to verify the person and thereafter sign the cheque are all matters which have to be gone into during the course of the Trial. 7. In view thereof, since there is a material to proceed against the petitioner, this Criminal Original Petition is not entertained. However, all the grounds raised in the quash petition shall be raised before the Trial Court. 8. Considering the fact that the case is of the year 2011 and the petitioner is aged 76 years, the presence of the petitioner before the Trial Court stands dispensed with, except for such necessary hearings as may be insisted upon by the Trial Court. 9. This Criminal Original Petition stands disposed of.
