This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 28/2025, registered at Police Station – Kirandul District – Dantewada (C.G.) for the offence punishable under Sections 318(4), 111(3) of the BNS and Section 66(D) of the I.T. Act. 2. According to the prosecution, the complainant the applicant P. Prasad VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.01.21 11:49:04 +0530 2 posted in NMDC Kirandul lodged a report in the Kirandul police station to the effect that on 30.05.2025 at around 07.45 pm, he received a Whatsapp call on his mobile number 9425591809 from mobile number 7684080552. On receiving the call, a person threatened him that a bank account is opened in the name of the applicant in Mumbai, in which a case of money laundering has been registered against the applicant by Mumbai police. The said person asked him to transfer Rs 28 lakhs to another mobile number 7609813145 in the name of setteling the case. Fearing the words of the accused, the applicant transferred Rs. 7 lakhs first and later Rs. 21 lakhs in the same account, totaling Rs.28 lakhs, through RTGS on 31/05/2025 from his own state bank of India account number 10727605327 257409612092, IFC code INDB0001455 mentioned by number to the account the accused. Later, when the applicant suspected that he was being cheated, he filed a complaint in this regard. When the police station was informed, a case was registered against the holder of the bank of mobile numbers 7684080552 and 7609813145 and account number 257409612092 at police station Kirandul under Crime No. 28/2025 for offence punishable under Section 318 (4) B.N.S and 66 (D) of the IT Act was registered and without investigation section 111 (3) for organized crime was been added of B.N.S of 2023. 3. Learned applicant submits that applicant has been falsely implicated in the present case registered as Crime No. 28/2025 at Police Station Kirandul, the copy of the FIR being annexed as Annexure A-2; that the applicant has been in judicial custody since 04.07.2025 and is the sole earning member of his family, and his prolonged detention is seriously 3 prejudicing his future as well as causing grave hardship to his family; that the applicant’s friend lodged a written complaint dated 09.07.2025 before the Police Commissioner regarding the applicant’s illegal detention and sought CCTV footage, a copy whereof is annexed as Annexure A-3, and that prima facie evidence in the form of CCTV/video footage of about seven hours, as reflected in the document list, clearly shows that the account holder Manjeet Manveer Singh, in collusion with the police, has falsely implicated the applicant and that both were illegally detained by the police since 03.07.2025; that Manjeet Singh is the holder of the account in which the disputed amount of Rs.5,00,000/- was received and is also the sole proprietor of M.M.S.T. Grow Energy One Person Company Pvt. Ltd., having account No. 10206408263 with Customer ID No. 6536435666, in which a fraud of Rs.12,00,000/- has already occurred; that the account used in the present incident is RBL Bank Account No. 409002376579, Vasai West Branch, in which Manjeet Singh received Rs.5,00,000/-, and the bank statement prima facie indicates that the police have protected him by not arraying him as an accused and have instead projected him as a witness; that despite receipt of the said amount, Manjeet Singh neither made any inquiry from the bank nor lodged any complaint with the police and has utilised the entire amount, which the police have failed to seize; that no incriminating material has been seized from the possession of the applicant in connection with the present case; that the other co-accused persons have already been granted bail by this Hon’ble Court on 10.10.2025, and even as per the charge-sheet, all other co-accused including the main accused stand released on bail; that the applicant is a 4 permanent resident of the address mentioned in the cause title of the bail application and there is no likelihood of his absconding or tampering with prosecution witnesses and that the applicant is ready and willing to furnish adequate surety and shall abide by all the directions and conditions as may be imposed by this Hon’ble Court while granting bail. 4. On the other hand, learned State Counsel opposes the bail application of the present applicant and submits that the charge-sheet has already been filed in the present case. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the overall facts and circumstances of the case, the nature and gravity of the allegations levelled against the applicant, the fact that the co-accused namely Suraj Chauhan, Aftab Sama, Pariya Ajay and Kishan Wader have already been granted bail by this Court in MCRC Nos. 6388/2025, 7693/2025, 7695/2025 and 7694/2025 vide order dated 10.10.2025, coupled with the fact that the charge-sheet has already been filed before the competent Court, that the applicant has remained in judicial custody since 04.07.2025, and that the conclusion of the trial is likely to take considerable time, this Court is of the considered opinion that the applicant has made out a fit case for grant of regular bail. 7. Let applicant, Arpit Singh, involved in Crime No. 28/2025, registered at Police Station – Kirandul District – Dantewada (C.G.) for the offence punishable under Sections 318(4), 111(3) of the BNS and Section 66(D) of the I.T. Act, be released on bail on furnishing 5 personal bond with two local sureties in the like sum to the satisfaction of the court concerned with the following conditions:- (i) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (ii) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against him under Section 269 of Bharatiya Nyaya Sanhita. (iii) In case, the applicant misuses the liberty of bail during trial and in order to secure his presence, proclamation under Section 84 of BNSS. is issued and the applicant fails to appear before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against him, in accordance with law, under Section 209 of the Bharatiya Nyaya Sanhita. (iv) The applicant shall remain present, in person, before the trial court on the dates fixed for (i) opening of the case, (ii) framing of charge and (iii) recording of statement under Section 351 of BNSS. If in the opinion of the trial court absence of the applicant is deliberate or without sufficient cause, then it shall be open for the trial court to treat such default as abuse of liberty of bail and proceed against him in accordance with law. 8.
