Arunkumar For Respondent(s): Mrs.R.S.Indira Government Advocate (Crl.Side) https://www.mhc.tn.gov.in/judis CRL OP No. 15701 of 2026 __________ Page2 of 5 ORDER The petitioner who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 316(2), 318(4), 61(2) of BNS 2023 and 21(3), 22 of BUDS Act 2019 in Crime No.5 of 2025, on the file of the respondent Police, seeks anticipatory bail. 2. The allegation against the petitioner is that the petitioner colluded with other accused persons, collected Rs.72 Lakhs from the defacto complainant under the guise of investment and subsequently cheated him. Hence the complaint. 3. Learned counsel for the petitioner submitted that the petitioner is mother-in-law of A1. The petitioner is nothing to do with the alleged offence. She has been falsely implicated in this case. Hence, he prayed to grant anticipatory bail to the petitioner. 4. Learned Government Advocate (Crl.Side) appearing for the respondent submitted that out of Rs.72 lakhs of cheated amount, Rs.20 lakhs was paid into the petitioner’s account. In this case, the petitioner is an accused of cheating the de facto complainant out of Rs. 72 Lakhs under the pretense of an investment opportunity. Although specifically directed by this Court to produce records verifying that the funds received from the complainant were genuinely invested, the petitioner has failed to submit any evidence. Considering the fact that the substantial amount involved in this case and the complete absence of records proving any legitimate investment in furtherance of the received funds, this Court is not inclined to grant anticipatory bail to the petitioner." 6.
