Petitioner has filed this writ petition seeking following reliefs. “10.1 That, the records pertaining to the service of the petitioner may be kindly be called for kind perusal of this Hon'ble Court. 10.2 That, the Hon'ble Court may kindly be pleased to direct the respondent authorities for considering and granting seniority to petitioner since year 2016with consequential benefits and monetary benefits including interest, in the interest of justice. 10.3. That, the Hon'ble Court may kindly be pleased to direct the respondent authorities for granting actual promotion to petitioner as Executive Engineer with consequential PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 3 benefits and monetary benefits including interest, in the interest of justice. 10.4. That any other relief which this Hon'ble court may deem fit and just in the facts and circumstances of the case.” 2. Learned counsel for petitioner submits that when petitioner was posted as Sub-Engineer in the Public Health Engineering, Sub-Division, Katghora, one departmental enquiry was initiated against him which continued till 2023. The Enquiry Officer after conclusion of the enquiry, submitted a report mentioning that all six charges framed against petitioner were not found to be proved. Based on the enquiry report, disciplinary authority ie., Engineer-In-Chief, Public Health Department had accepted the enquiry report and has ordered that the enquiry proceedings initiated against petitioner to be closed and it is accordingly closed. Subsequently petitioner was considered for promotion and vide order dated 25.09.2023, he was promoted on the post of Assistant Engineer. Petitioner thereafter submitted a representation mentioning that the seniority of petitioner be refixed from the date when his juniors were promoted, however, till date no decision has been taken. He also submits that according to the information of petitioner only because of the enquiry proceedings pending against petitioner, he was not considered for promotion in the DPC conducted on 12.12.2022 and therefore petitioner is entitled for his promotion from the date when juniors to petitioner have been promoted. He submits that in the facts of the case, respondents be directed to consider claim of petitioner. 3. Learned State counsel submits that as the main thrust of petitioner is to direct the respondents authorities to take decision on the claim of petitioner based on the report submitted by petitioner earlier, as the copy of representation is not filed along with writ petition, petitioner can submit fresh representation before the authority raising his grievance as raised in this writ petition and if such a representation is submitted it will be considered in accordance with law. 3 / 3 4. At this stage, learned counsel for petitioner submits that petitioner may be permitted to submit fresh representation and the concerned authority be directed to take decision on the representation to be submitted by petitioner at the earliest. 5. On due consideration of the submission made by learned counsel for the respective parties, facts and circumstances of the case, this writ petition at this stage is disposed of permitting the petitioner to submit a comprehensive representation along with all supporting documents before Respondents No. 2 and 3 and if such a representation is submitted the concerned authority shall consider and take decision on the representation in accordance with law, expeditiously, preferably within a further period of 03 months from the date of receipt of representation. 6.
