The case of the prosecution is that on 07.07.2026, on conducting surprise inspection, the petitioner was found in possession of 18 pockets of tobacco products. Hence, the case. 3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner. 4. The learned Government Advocate (Crl.Side), appearing for the respondent Police, reiterated the prosecution case and submitted that FIR in Crime No.210 of 2026 has been registered against the petitioner under Section 24(1) of the Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution), Act, 2003 and the petitioner has four previous cases of 2/4 https://www.mhc.tn.gov.in/judis
Crl.O.P.No.18449 of 2026 similar in nature. He would further submit that, if the petitioner is granted anticipatory bail, there is every likelihood of indulging in similar offences in future. Therefore, he vehemently opposed the grant of anticipatory bail to the petitioner. 5. I have given my anxious consideration to either side submissions. 6. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the petitioner has four previous cases of similar in nature.
It is also evident that, if anticipatory bail is granted to the petitioner, it will have an adverse impact on society. Considering the antecedents of the petitioner, the nature of the allegations and the interest of society at large, this Court is not inclined to grant anticipatory bail to the petitioner. 7.
