Heard learned counsel Mr. A. Gautam for the petitioner Mantu Ray @Montu Rai. 2. The petitioner has filed this application under Section 483 of the Bharatiya Page No.# 2/3 Nagarik Suraksha Sanhita, 2023 with prayer for bail as he is behind bars since 18.03.2026 in connection with Jagiroad Police Station Case No. 55/2026 corresponding to GR Case No. 245/2026 under Sections 20(b)(ii)(B) and 25 of the NDPS Act, 1985. 3. Heard Mr. B. Sharma, learned Additional Public Prosecutor for the respondent State. 4. The allegation against the petitioner is that 5.90 kgs of Ganja was recovered from his house. 5. petitioner has prayed for bail as he is suffering from cardiomegaly and pulmonary oedema. Annexures-9 & 10 which are submitted along with the petition are the reports and medical documents relating to the petitioner’s ailment. It is further submitted that the petitioner will co-operate with the investigation. 6. Learned Additional Public Prosecutor has raised objection against the petitioner’s prayer for bail. 7. I have considered the submissions at the Bar with circumspection. 8. I have considered the length of detention undergone by the petitioner. I have considered the submission that the petitioner is suffering from heart ailment. The petitioner has pledged to co-operate with the investigation and he does not appear to be a flight risk. 9. Considering all aspects, the petitioner is enlarged on bail of Rs. 50,000/- with a suitable surety of like amount to the satisfaction of the learned Jurisdictional Court/Elaka Magistrate, under the conditions that: (i) The petitioner shall refrain from such Page No.# 3/3 activities with which he is alleged, (ii) The petitioner shall co-operate with the remaining part of investigation, and (iii) The petitioner shall not leave the jurisdiction of the Court without prior permission. 10. On breach of any of the bail conditions, the Court is at liberty to immediately cancel the bail granted to the petitioner. 11. In terms of the above observation, Bail Application stands disposed of.
