This is first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita 2023 for grant of regular bail to applicant, who has been arrested in connection with Crime No.336/2025, registered at PS -Telibandha, District - Raipur (C.G.), for commission of offence punishable under Sections 103, 3(5) of the BNS; Section 25 & 27 of the Arms Act and Section 4/181, 5/180 of the Motor Vehicle Act. 2 2. Case of prosecution, in brief, is that on 03.06.2025 on account of previous enmity regarding money, Vicky Barvey and Rohan Barvey assaulted Raja Tandekar @ Girja Shankar by means of knife, due to which, he suffered grievous injuries, he was taken to the hospital where he declared died. After the alleged incident, accused persons called present applicant and one Himanshu and fled away from the spot. Based upon report of complainant, FIR was registered against the accused persons including the present applicant. Hence this bail application. 3. Learned counsel for the applicant submits that applicant has been falsely implicated in this case, he has not committed any offence as alleged against him as ingredients of the aforementioned offence is missing in the instant case. Name of this applicant is not mentioned in the FIR. During investigation, main accused persons were arrested and in their memorandum they have stated that present applicant helped them to successfully fled away from the spot in a vehicle. There is no direct involvement of the applicant in the alleged crime/incident. Applicant was unaware about the incident occurred just before meeting the accused persons. Nothing has been seized from the applicant. Applicant is not having any previous criminal antecedent, he is in jail since 05.06.2025, conclusion of trial may take some time, hence, applicant may be released on bail. 4. Per contra, learned State Counsel opposing the bail application of the applicant. 5. Heard learned counsel for the parties. 3 6. Considering facts of the case, nature of allegations, submissions of learned counsel for the parties, particularly the fact that main accused is Vicky Barvey and Rohan Barvey, who assaulted the deceased by means of knife, further considering that name of present applicant is not mentioned in the FIR, he has been arrested/implicated in this case only on the basis of memorandum statements of the main accused persons, further considering the role played by the applicant in the alleged crime and his detention period and fact that conclusion of trial may take some time, without commenting anything on merits of the case, I am inclined to allow this bail application. 7. Accordingly, bail application is allowed. It is directed that applicant shall be released on regular bail, on his furnishing a bail bond in sum of Rs.10,000/- with one surety in like sum to satisfaction of concerned Court on the conditions that- a) Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. b) Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial, and c) Applicant shall appear before trial Court on each and every date given to him by the said Court till disposal of the trial.
