ORDER:
On reading of the prayer in the Civil Revision Petition, it appears that the trial Court has not registered the petitioner’s application and memo dated 06.05.2026 filed under Order VIII Rule 1A(3) r/w Section 151 of the Code of Civil Procedure, 1908 in F.C.O.P.No.19 of 2023 on the file of the learned Family Court-cum-VI Additional District Judge, Kadapa.
2. In the affidavit filed in support of the said application indicates that the petitioner’s evidence was eschewed and posted the case for arguments to
06.03.2026. On that day, arguments were heard on behalf of petitioner in F.C.O.P. and posted for miscellaneous. Thereafter, the petitioner herein filed petitions to reopen and set aside the eschew order and to recall for giving evidence. The said petitions were allowed on payment of costs with a condition to attend the Court on the next date of hearing for giving evidence. As she is suffering from some problems, she could not attend the Court and filed the application along with documents to show reasons for her absence for giving evidence on a particular day. The said application was not numbered. Hence, the present Civil Revision Petition is filed.

Learned counsel for respondent filed counter-affidavit in the present Civil Revision Petition and stated that the respondent has no objection to receive, number and to consider the petitioner’s application filed in F.C.O.P.No.19 of 2023 in accordance with law. However, the respondent only

requested to direct the trial Court to dispose of F.C.O.P. as expeditiously as possible.

Therefore, the present Civil Revision Petition is disposed of directing the trial Court to register the application filed by the petitioner and pass appropriate orders on merits and in accordance with law. The trial Court is further directed to consider the case of the respondent for expeditious disposal of F.C.O.P. There shall be no order as to costs.
As a sequel thereto, interlocutory application pending, if any, shall stand closed.
