At the outset, Sri Avinash M.Angadi would submit that present petitioner-Smt.Anita H.Patil being the Director, would stand on the same footing that of Sharanappa alias Sharanagouda, who was the petitioner in Criminal Petition No.103560/2024 and this Court by order dated 14.01.2026 quashed the pending criminal case insofar as the said Sharanappa is concerned. Accordingly, similar order be passed in this petition. 3. Per contra, Smt.Kirtilata R.Patil, learned High Court Government would contend that in respect of the present petitioner, there is an allegation that she has acquired the - 3 - HC-KAR NC: 2026:KHC-D:2288 CRL.P No. 104558 of 2025 property of the company in her name defrauding the defacto complainant, but she is unable to point out what is the material collected by the investigation agency to substantiate such an allegation as against the petitioner herein. 4. Accordingly, this Court is of the considered opinion that the present petition also needs to be allowed in terms of the order passed in Criminal Petition No.103560/2024. 5. Hence, following: ORDER i. Petition is allowed in terms of the order passed in Criminal Petition No.103560/2024. ii. Pending proceedings in S.C.No.82/2023 on the file of the Additional District and Sessions Judge at Gadag against the petitioner is hereby quashed.
