According to the petitioners, they were appointed as Shiksha Mitra in different Primary Schools in District Champawat. As per the pleadings, petitioner no. 1 was appointed in 2001; while, petitioner no. 2 was appointed in 2007. 4. It is the case of the petitioners that they possess all eligibility conditions for regular appointment as Assistant Teacher, Government Primary School; they have qualified TET-I and they also possess D.El.Ed. qualification, which is sufficient for appointment as Assistant Teacher. Petitioners have relied upon a Government Order dated 16.08.2019, wherein it was provided that such Shiksha Mitra, who possess two years D.El.Ed. qualification and have also passed TET may be given regular appointment. 5. By means of this writ petition, petitioners have sought the following relief:- “i. Issue a writ, order or direction in the nature of mandamus commanding the respondents to grant appointment to the petitioners on the post of Assistant Teacher, Government Primary School, like other Shikshya Mitra.” 2026:UHC:21 6. Learned State Counsel submits that since petitioners have sought a writ of mandamus and they have also made a representation to the competent authority, therefore, the competent authority be directed to look into the grievance raised by petitioners in their representation. 7. Learned counsel for the petitioners, however, submits that petitioners be permitted to make fresh representation. 8. Accordingly, the writ petition is disposed of by permitting both the petitioners to make separate representation to the District Education Officer (Elementary), Champawat, within ten days from today. If petitioners make representation within stipulated time, the District Education Officer concerned shall examine the matter and take decision, as per law, within eight weeks thereafter.
