The applicant who is in custody since 23.03.2022 has renewed the prayer for grant of regular bail in connection with Karra P.S. Case No.50 of 2021, corresponding to NDPS Case No.42(A)/2021, registered for the offence under Sections 15 and 25 of the NDPS Act, pending in the court of learned Additional Session Judge-III, Khunti. 2. It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part. 3. Earlier the bail application of this applicant was rejected on merit vide order dated 06.04.2023 passed in B.A. No.821 of 2023. This is the second attempt. 4. Prayer for bail of the applicant has been renewed stating that he has roped in only on the basis of confessional statement of the co-accused and similarly situated other co-accused has already been enlarged on bail. On the above basis, prayer for bail has been renewed. 5. Learned A.P.P. has opposed the prayer for bail of the applicant. 6. From perusal of record, it appears that 560 kgs of doda has been recovered which is commercial quantity. 7. Considering the mandate of Section 37 of the N.D.P.S. Act, I am not inclined to reconsider the prayer for bail of the applicant, at this stage. Accordingly, prayer for bail of the applicant stands rejected once again.
