No. 324 of 2026 __________ Page2 of 4 2. Heard Mr.J.Magesh, learned counsel for the petitioner and Mr.Rajesh, learned counsel appearing for the respondent. 3. Learned counsel appearing on behalf of the respondent would submit that he had already entered appearance on behalf of the respondent and also submits that he has no objection in appointing an Arbitrator to resolve the disputes between the parties amicably. 4. A notice under Section 21 of the Arbitration and Conciliation Act, 1996 has been issued by the petitioner on 29.11.2025. In spite of the same, the respondent has not chosen to respond. From a reading of the Franchise Agreement dated 07.12.2024 entered to between the petitioner and the respondent, it could be seen that the parties have agreed to resolve the disputes by appointing an Arbitrator. 5. In view of the Loan Agreement and considering the nature of claim, this Court deems it appropriate to appoint an Arbitrator. Accordingly, Mr.S.Diwakar, Advocate, (Mobile No.9884670187) having office at Ground Floor, No.48, Eldams Road, Alwarpet, Chennai – 600 018, is appointed as Sole Arbitrator to enter upon the reference and resolve the disputes between the petitioner and the respondents. https://www.mhc.tn.gov.in/judis Arb O.P(COM.DIV.) No. 324 of 2026 __________ Page3 of 4 6. The learned Sole Arbitrator is entitled to fix his fees as per the Schedule-IV of the Act. This Court further requests the learned Sole Arbitrator to endeavour to decide the dispute as expeditiously as possible. 7. Accordingly, this Arbitration Original Petition is ordered.
