ORAL ORDER
(PER: THE HON'BLE MR. JUSTICE V.SRISHANANDA)
1. Heard Sri. Vidyashankar G. Dalawai, learned counsel for petitioners and Sri. P. N. Hatti, learned High Court Government Pleader for respondents. 2.
This petition is filed by the petitioners under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, with the following prayer:
“WHEREFORE, the petitioners respectfully prays that this Hon’ble Court be pleased to allow the petition filed under Section 482 of BNSS and grant anticipatory bail to the petitioners in the event of registration of any complaint by Manjula W/o. According to the petitioners there is a rift in the matrimonial life and father- in-law of petitioner No.1 is threatening that he would approach the police and get the petitioner No.1 and his relatives arrested so as to degrade them in the Public Lite. 5. Petitioners have now sought for grant of anticipatory bail on the real apprehension of arrest. 6. Learned High Court Government Pleader for respondents would oppose the bail grounds on the ground that there is no registration of the FIR itself and therefore, the request of the petitioners cannot be considered. 7. Having heard the arguments of both sides, this Court perused the material on record meticulously. 8. On such perusal of material on record, it is found that there is a real apprehension of arrest. More so,

petitioner No.1 being an Advocate and other petitioners are his relatives. 9. Thus, following the dictum of the Hon'ble Apex Court in the case of Shri. Gurbaksh Singh and Others Vs.
State of Punjab1 and in the case of Siddharam Satlingappa Mhetre Vs. State of Maharashtra and Others2, this Court is of the considered opinion that limited protection can be given to the petitioners. 10. Hence, the following: ORDER (i) The petition is allowed.
