11.07.2024. Respondent No.4, by the impugned order dated 22.09.2025, rejected the said application on the ground that a criminal proceedings has been registered at the instance of the petitioner’s sister-in-law, in which the petitioner was arrayed as accused No.4, and that a charge- sheet had been filed. Sections 323, 498A, 504, and 506 read with Section 34 of the Indian Penal Code. It is contended that the impugned
order proceeds on a complete misinterpretation of the Karnataka Civil Services (Appointment on Compassionate Grounds) Rules, 1996.
6. Per contra, the learned Additional Government Advocate appearing for the respondents/State justifies the impugned order and submits that the same does not warrant interference by this Court. It is submitted that compassionate appointment is not a matter of right and that authority has exercised its discretion in accordance with law.
7. This Court has carefully considered the rival
contentions and perused the impugned order. The relevant portion of the impugned order reads thus:

The rejection of the petitioner’s application is founded solely on a premise that a criminal case is pending against her. Sub-Rule 4 of Rule 3 of the Karnataka Civil Services (Appointment on Compassionate Grounds) Rules, 1996 (‘Rules 1996’ for short) reads thus:
“A person against whom at the time of making an application a criminal case is under investigation or trial, on the charge of having committed murder of the deceased Government servant or for abetting the commission of such offence shall not be eligible for appointment under these Rules.”

HC-KAR NC: 2026:KHC-D:95 WP No. 109772 of 2025
9. A plain reading of the above provision makes it abundantly clear that disqualification is attracted only in cases where the applicant is facing criminal proceedings relating to the murder of the deceased Government servant or abetment thereof. The Rule does not contemplate disqualification on account of criminal proceedings initiated by a third party in respect of unrelated offences. 10. In the present case, the criminal proceedings relied upon by respondent No.4 are admittedly not in relation to the death of the deceased Government servant, nor do they pertain to any allegation of murder abetment thereof. Therefore, the petitioner does not fall within the category of ineligible persons under Sub-Rule (4) of the Rule 3 of Rules 1996 governing compassionate appointment.
The rejection of the petitioner’s application on such ground is unsustainable in law and warrants interference. - 8 -

11. The impugned order demonstrates a clear misinterpretation of the statutory Rules. Accordingly, the following:
ORDER i. The writ petition is allowed in part. ii. Impugned endorsement dated 22.09.2025 (Annexure-H) passed by respondent No.4 is hereby quashed being contrary to Sub-Rule (4) of Rule 3 of the Rules 1996. iii. Respondent No.4 is directed to reconsider the application of the petitioner for compassionate appointment, without taking into criminal case referred in the impugned
order and to assess her eligibility in accordance with Rules, 1996.
