Since the learned counsel for the petitioner has confined his prayer for a request to the learned District Judge, Nainital for hearing the stay application in the revision. Hence, it appears to be innocuous prayer. Learned counsel for respondent no.2 Mr. Sanjay Bhatt also does not oppose such a prayer. A perusal of the order dated 17.04.2026 which has been impugned by means of the present petition reveals that the petitioner who is a revisionist before the District Judge, Nainital, has not taken steps to serve the respondent no.1. If the steps have already been taken and the respondent no.1 has been served, in that eventuality, the request is made to the learned District Judge, Nainital to hear the revisionist/ petitioner herein either on the Stay Application or if the parties are ready to argue on the merit, the same may be decided as soon as possible.
