CRL OP No. 19072 of 2026 __________ Page2 of 4 ORDER The petitioners apprehend arrest for the alleged offence under Sections 189(2), 296(b), 115(2), 118(1), 351(3) of BNS Act, in Crime No.167 of 2026 on the file of the respondent police seeks anticipatory bail. 2. The allegation against the petitioner is that the petitioners and the defacto complainant are neighbours, and due to previous enmity, on the date of alleged occurrence, the petitioners assaulted the defacto complainant with stone, causing grievous injuries to him and also threatened with dire consequences. Hence, the complaint. 3. The learned counsel appearing for the petitioners submitted that the present matter arises out of a case and counter-case, and that the alleged occurrence took place on 19.06.2026. He further submitted that the de facto complainant herein is arrayed as an accused in the counter-complaint lodged by the petitioners' side, and as a retaliatory measure, a false case has been foisted against the petitioners. Hence, he prayed for the grant of anticipatory bail to the petitioners

CRL OP No. 19072 of 2026 __________ Page3 of 4 respondent police reiterated the prosecution case and submitted that the defacto complainant sustained serious injuries and was admitted in the hospital on 19.06.2026 and discharged on 08.07.2026. Hence, she opposed to grant anticipatory bail to the petitioner. 5.
Considering the above aspects, the nature and gravity of the injuries sustained by the defacto complainant, this Court is not inclined to enlarge the petitioners, as the same may embolden them to commit similar offences and would send a wrong signal to the society. 6.
