JUSTICE V.SRISHANANDA) Learned counsel for the petitioner filed a memo seeking withdrawal of the petition. The memo reads as under: “The Petitioner respectfully submits as under- 1. The petitioner filed this petition seeking bail under section 483 (1) of BNSS 2023 in Spl. Case No. 35/2025 pending on the file of 2nd Addl. Dist & Sessions Judge Karwar, for the offences punishable under section 103, 54 r/w section 34 of BNS and section 3(2) (v) of SC/ST (POA) Amendment Act 2015. 2. The petitioner approached the High court Legal Service Committee, Dharwad bench, through DLSA Karwar on 14/07/2025 requesting to appoint a panel Advocate on her behalf for filing the bail petition in the afore said case number. The HCLSC Dharwad authorized me on 10/09/2025 for filing the bail petition. Accordingly I filed bail petition on 18/11/2025 before this Hon'ble court. After scrutinizing the petition by office, the office has raised the objection at Sl. No. 7 regarding as earlier the petitioner filed Crl.A. No. 100583/2025 - 3 - HC-KAR NC: 2026:KHC-D:647 CRL.P No. 104966 of 2025 before this Hon'ble court and sought for similar relief. 3. After verifying the said appeal number, it is noticed that, the petitioner earlier engaged the private Advocate and filed the said appeal on 08/09/2025 and got disposed off the appeal on 15/10/2025. However the petitioner had not brought notice to the HCLSC Dharwad. Therefore the present petition is does not survive for consideration. Hence the petition may kindly be dismissed as withdrawn the present in the interest of justice.” Placing the memo on record, petition is dismissed as withdrawn.
