JUSTICE BIPIN GUPTA Judgment / Order 27/03/2026 1. Both parties are in agreement that though the possession has been handed over to the respondent in pursuance of the eviction certificate dated 20.04.2024, as well as the 17.01.2026. 2. However, the material of the petitioner is lying in the dispute premises, therefore, in such view, both the parties are in agreement that 6 months time may be granted to the petitioner to vacate the premises and remove his material from the subject premises, subject to payment of mesne profit @ 12,000/- per month from 01.04.2026. 3. Learned counsel for the respondents, upon instructions from his client, submits that they have no objection if the time prayed for by the petitioner, to vacate the tenanted premises, is granted. [2026:RJ-JP:12822] (2 of 2) [CW-5630/2026] 4. On consent of the parties, petitioner is granted six months' time to vacate the premises. On the following consented terms: (i). The petitioner will vacate the premises on or before 26.09.2026. (ii). The petitioner shall pay all the arrears of the rent as per the decree within a period of four weeks. (iii). Petitioner undertakes to pay mesne profit @ Rs.12,000/- per month from 01.04.2026. (iv). Petitioner is directed to file an undertaking before the learned Rent Tribunal, to the effect that it will vacate the premises, on or before 26.09.2026 and further to the effect that it will continue to pay the mesne profit @ Rs.12,000/-, per month till vacation of the premises and further it will not sub-let or create any alteration in the disputed premises. (v). The mesne profit, which is to be paid from 01.04.2026 shall be paid by the petitioner by 15th day of the succeeding month. If it makes default for three consecutive months in payment of the mesne profit, then the respondents shall be entitled to execution for decree. (vi). If the order passed by this Court is not complied with by the petitioner, then it will be liable for contempt of Courts proceedings. 5. In view of the above, the learned Rent Tribunal is directed to to hand over possession to the petitioner for compliance of this order. 6. With the above observations, the present Civil Writ Petition stands disposed of. 7. Pending application(s), if any, also stand disposed of. (BIPIN GUPTA),J KRATIKA /17
