The present Special Leave to Appeal has been filed under Section 419 of the Bharatiya Nagarik Suraksha Sanhita, 2023, challenging the judgment and order dated 05.02.2026 passed by the learned Chief Judicial Magistrate, Udham Singh Nagar in Criminal Case No. 2102 of 2023, “State vs. Mohd. Afzal Ansari and Others”, relating to offences punishable under Sections 498-A, 323, 504 and 506 of the IPC and Sections 3/ 4 of the Dowry Prohibition Act, arising out of proceedings registered at Police Station Pantnagar, District Udham Singh Nagar.
4. As per the office report dated 08.05.2026, notice has been duly served personally upon Respondent Nos. 3 and 4, and upon Respondent No. 2 through his brother. However, despite service being sufficient, none has put in appearance on their behalf.
5. Upon consideration of the submissions advanced by learned counsel for the Appellant and upon perusal
of the material available on record, this Court is of the view that, at this stage, sufficient grounds exist for grant of leave. Accordingly, the Special Leave to Appeal is granted.
6. Though none has appeared on behalf of Respondent Nos. 2 to 4 despite sufficient service, yet in the interest of justice, one further opportunity is granted to the said Respondents to appear and contest the matter, if they so desire.
7. The Registry is directed to prepare the paper book and furnish copies thereof to learned counsel for the parties in accordance with the Rules.
8. Objections, if any, may be filed by the Respondents before the next date fixed.
9. List this case on 09.06.2026 for final hearing.
