Rajasekhar Advocate(s) for Respondent(s): GP for Endowments CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE R RAGHUNANDAN RAO DATE : 16th April 2026 P C : The appellant has preferred this writ appeal aggrieved by the observations made in para No.5 of the judgment and order impugned, dated 06.04.2026, in which the learned single Judge has observed that there were no express proceedings after 2006 recognizing the petitioner herein as Founder Family Member of the Andhra Jatheeya Vidya Parishad, Machilipatnam, by the Commissioner, Endowments Department. 2. The observation, it is stated, is contrary to the judgment of this Court in W.A. No.847 of 2025. Apart from this, it is stated that the petitioner being a member of the Founder’s Family ought to have been permitted exclusively to 2 HCJ & RRR, J W.A. No:420 of 2026 celebrate the Founder’s Day, which otherwise was to be celebrated on 08.04.2026. It is stated that the direction contained in para No.6 of the judgment and order impugned in the present appeal to the extent it directed the celebration of Founder’s Day by the Executive Officer of the Andhra Jatheeya Vidya Parishad or any other officer or committee duly appointed by the Commissioner, Endowments in coordination with respondent No.3 - the Andhra Jatheeya Vidya Parishad, was untenable in law. 3. It can be seen that the order impugned is passed in a writ petition, which is still pending final consideration. By virtue of the judgment and order impugned, the learned single Judge has found a prima facie case to the extent that Founder’s Day has to be celebrated as per the notification of the 43 Register and therefore, the said direction to that extent cannot be found fault with. 4. The official respondents shall, therefore, take steps to celebrate the Founder’s Day not later than two weeks from today in terms of the orders passed by the learned single Judge and reflected in para No.6 of the said judgment and order. However, since the matter is still pending consideration before the learned single Judge, the observations made in para No.5 of the said judgment and order shall not come in the way of the learned single Judge at the time of final disposal of the writ petition upon detailed hearing of the matter.
