CRL OP No. 18572 of 2026 __________ Page2 of 5 ORDER The prayer in the criminal original petition is to quash the First Information Report in Crime No.125 of 2022. 2.Upon considering the allegations in the FIR, the case is registered on complaint by the defacto complainant that originally when the property belonged to one Francis Sundararaj, fake records were thereafter created as if some unconnected persons are his legal heirs and further transactions are created and hence, the case is registered for the alleged offences under Sections 420, 465, 467, 468, 471 r/w 120 B of the Indian Penal Code. 3.The contention of the learned counsel for the petitioner is that the petitioner is not a party to any of the transaction and absolutely there is no material as against this petitioner. The second contention is that even though the case is registered in the year 2022, the same is eternally kept pending. 4.Per Contra, the learned Government Advocate (Crl.side) would submit that when Susheela Francis, Jehosh Vijayendran and Joshwa Mahendran were only the legal heirs of Francis Sundararaju, who was the owner of the property, fake legal hardship certificate, as if one Rakesh and Antony were the legal https://www.mhc.tn.gov.in/judis
CRL OP No. 18572 of 2026 __________ Page3 of 5 heirs, was forged and thereafter, a power of attorney is executed in favour of one Shankar, who is none other than the driver of the petitioner.
Similarly, further transaction’s money was made to be paid in A5’s account, who is also working under the petitioner. It is the allegation that the petitioner is the mastermind behind the entire episode. 5.In view of the said submissions made, it cannot be said that there is no materials at all to investigate into matter. The role played by each and every accused will come out only at the end of the investigation. As far as the second grievance of the petitioner is concerned, the same can be addressed by directing the respondents to complete the investigation within such short time. Due importance shall be given by the Investigating Officer to apply his mind with reference to the forgery. When the entire episode is proven to be false, such contra documents should be made on record and further, if any signature is alleged to be forged by any person then due samples to be taken and due expert evidence from the concerned expert shall also be obtained. Considering the nature of the case, the investigating officer cannot keep the matter pending eternally. Let the investigation be completed swiftly, in any event, not later than four months from the date of receipt of the web copy of the order. https://www.mhc.tn.gov.in/judis
