VENNA HEMANTH KUMAR(CENTRAL GOVERNMENT COUNSEL) 4 THE HONOURABLE SMT JUSTICE KIRANMAYEE MANDAVA WRIT PETITION NO: 7000/2026 The Court made the following Order: Heard the learned counsel for the petitioner, learned Assistant Government Pleader for School Education and the learned Standing Counsel for NCTE appearing for the respondent Nos.4 & 5/NCTE. 2. The grievance of the petitioner in the instant Writ Petition is against the action of the respondents in withdrawing the recognition granted to the petitioner Institution. 3. Learned counsel for the petitioner relied on the decision of a Coordinate Bench of this Court in W.P. Nos. 18253 of 2024 and batch, wherein the Court granted liberty to the petitioner to submit an explanation to the show-cause notice within a period of four (04) weeks and directed the respondents to pass appropriate orders upon receipt of such explanation. 4. Learned counsel for the petitioner further submits that the issue raised in the instant writ petition is covered by the said judgment of this Court. 5. Learned Standing Counsel appearing for the respondent No.5 would submit that, despite the show cause notice, the petitioner did not respond to the show cause notice. Having regard to the same, the impugned order was passed against which an alternative remedy of 5 Appeal is provided under Section 18 of the NCTE Act, 1993. Thus the Writ Petition is not maintainable and prays for dismissal of the Writ Petition. 6. Having regard to the submission made, the impugned show cause notice dated 16-01-2023 is set aside and the matter is remanded to the respondent No.5 for consideration afresh. The petitioner is also at liberty to file an explanation to the show cause notice, dated 16-01- 2023 to the respondent No.5 within a period of three (03) weeks from the date of receipt of the order. Upon filing of such an explanation to the show cause notice, the respondent No.5 is directed to pass appropriate orders within a period of four (04) weeks thereafter. 7. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
