Crl.O.P.No.19303 of 2026 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 21.07.2026 CORAM THE HONOURABLE Mr. JUSTICE C.KUMARAPPAN Crl.O.P.No.19303 of 2026 Rajarajasozhan ... Petitioner(s) Vs. The State rep. by The Inspector of Police, All Women Police Station, Thiruvarur, Thiruvarur District. ... Respondent(s) Crime No.3 of 2022 PRAYER : Criminal Original Petition filed under Section 483 of BNSS, 2023, to enlarge the petitioner on bail in S.C.No.92 of 2026 pending investigation on the file of the Additional Mahila Judicial Magistrate, Thiruvarur. For Petitioner(s) : Mr.L.Sarath Pandian For Respondent(s) : Mr.S.Yogaraj Sekar, Government Advocate (Crl.Side) ORDER The petitioner, who had earlier jumped bail, was issued a non-bailable warrant on 18.07.2022, pursuant to which he was arrested and remanded to judicial custody on 25.06.2026. 1/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.19303 of 2026 2. The learned counsel appearing for the petitioner would submit that a non-bailable warrant had been issued against the petitioner on 18.07.2022 and that he was subsequently secured and remanded to judicial custody on 25.06.2026. He would further submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for the grant of bail. 3. The learned Government Advocate (Crl. Side) appearing for the respondent, while opposing the grant of bail, reiterated the prosecution case and, on instructions, submitted that the petitioner had absconded for nearly four years and was secured only on 25.06.2026. He would further submit that the case is now posted for engagement of counsel and that the trial is yet to commence. 4. Considering the above facts and circumstances, particularly the past conduct of the petitioner in absconding for nearly four years after having been enlarged on bail, the stage of the criminal proceedings, and the submission of the learned Government Advocate (Crl. Side) that the trial is yet to commence, this Court is of the view that there is every likelihood of the petitioner abscondance again if he is enlarged on bail. Therefore, in order to secure his presence during trial, this Court is not inclined to grant bail to the petitioner. 2/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.19303 of 2026 5.
