ORDER This criminal original petition has been filed seeking to quash the proceedings in C.C.No.338 of 2024 on the file of the learned Judicial Magistrate No.I, Cuddalore, arising out of a charge sheet filed against the petitioner.
2. When the matter was taken up for hearing, the learned counsel for the petitioner submitted that the main criminal proceedings in C.C.No.1100033 of 2011, as against the first accused have already been quashed by this Court. He further submitted that the present case is a split- up case registered against the petitioner, who is arrayed as the second accused.
3. A perusal of the records reveals that the alleged occurrence took place in the year 2009 and the de facto complainant has subsequently passed away.
4. Considering the long passage of time since the occurrence is of the year 2009; that the main case against the co-accused (A1) already https://www.mhc.tn.gov.in/judis
CRL.OP.No.18184 of 2026 __________ Page3 of 4 stands quashed and the fact that the petitioner is not involved in any other criminal case, any further continuation of the trial at this distance of time would amount to an abuse of the process of law and cause oppression to the petitioner.
5. In view of the above, this criminal original petition is allowed and the charge sheet and all further proceedings in C.C.No.338 of 2024 pending on the file of the learned Judicial Magistrate No.I, Cuddalore, are hereby quashed.
