For Petitioner(s): Mr.B.Gopalakrishnan For Respondent(s): Mr.S.Yogaraja Sekar, Government Advocate (Criminal Side ) ORDER The petitioner, who was arrested and remanded to judicial custody on 14.04.2026 for the alleged offences under Sections 87, 351 (3), 118 (1) of BNS and Section 11 (5) r/w 12, 5 (1) r/w 6 of POCSO Act, in Crime No.4 of 2026 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner is approximately twenty-seven years old and the victim is approximately ten years old boy. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and produced the victim’s statement recorded under Section 183 of the BNSS, which contains serious allegations of sexual harassment. Hence, he opposed for grant of bail to the petitioner. 5.A perusal of the statement recorded under Section 183 of the BNSS, clearly demonstrates serious allegations of sexual harassment against the ten year old victim boy. Hence, this Court is of the firm view that, it is not desirable to enlarge the petitioner on bail.
