THIS CONTEMPT PETITION, COMING ON FOR ORDERS THIS DAY, ORDER WAS MADE THEREIN AS UNDER: - 3 - HC-KAR NC: 2026:KHC-D:206-DB CCC No. 100407 of 2025 CORAM: THE HON'BLE MR. JUSTICE M.I.ARUN AND THE HON'BLE MR. JUSTICE B. MURALIDHARA PAI ORAL ORDER (PER: THE HON'BLE MR. JUSTICE M.I.ARUN) In W.P. No.100952/2024, the following order is passed: “i) The petition is allowed. ii) The award dated 12.04.2023 passed respondent No.4 at Annexure-B insofar as it relates to petitioner's land is hereby quashed. iii) The respondents are directed to re-determine the compensation in respect of the subject land under the provisions of Act, 2013 insofar as it relates to the petitioner's land and pay the compensation re-determined after deducting the compensation which has already been disbursed to the petitioner. iv) The said exercise shall be concluded within a period of four months from the date of receipt of the certified copy of this order.” 2. The writ petition came to be disposed of on 22.02.2024. Admittedly, the complainant has obtained the certified copy of the order of the aforesaid writ petition on 18.03.2024 and has, immediately, served on the authorities concerned with a request to comply the order. However, the same has not been complied with. Hence, the present contempt - 4 - HC-KAR NC: 2026:KHC-D:206-DB CCC No. 100407 of 2025 petition was filed on 05.11.2025. This contempt petition has been filed beyond a period of one year. 3. Section 20 of the Contempt of Courts Act, 1971, reads as under: “20. Limitation for actions for contempt.—No court shall initiate any proceedings of contempt, either on its own motion or otherwise, after the expiry of a period of one year from the date on which the contempt is alleged to have been committed.” 4. As, admittedly, the contempt petition has been filed beyond a period of one year, the same is not maintainable and accordingly, the contempt petition is dismissed. However, it is hereby clarified that dismissal of the contempt petition will not come in the way of the complainant to pursue other remedies that may be available to him, in accordance with law.
