1. Mr. Ankush Singhal,
learned counsel, holding brief of Mr. Harshpal Sekhon, learned counsel for the petitioners.
2. Mr. B.C. Joshi, learned AGA for the State.
3. By the instant petition, petitioner no. 1 – Muskan, D/o Tahir Hussain, and petitioner no. 2 – Ashif Ali, S/o Sahid Ali, are praying for adequate protection, since there is threat perception from respondent nos. 4 and 5.
4. It is argued by learned counsel for the petitioners that both the petitioners were engaged for marriage with the consent of their family members but due to some differences marriage could not be solemnized, and now, they got married with each other, but their family members are against this marriage, therefore, there is threat perception from respondent no. 4 and 5. He further submits that both the petitioners are major and in support of their age, Adhar Cards have been enclosed.
5. Learned State Counsel has not disputed about their age.
6. Admittedly, both the petitioners are major and earlier they were engaged with the consent of their family members and now, they are married and if there is any threat perception from respondents no. 4 and 5, then the State administration is under legal obligation to assess such threat and take appropriate steps to secure their life and liberty.
7. In such view of the matter, the instant writ petition is disposed of finally with the direction to the SSP, Udham Singh Nagar – respondent no. 2 to make an assessment of the threat perception and if he comes to the conclusion that there is any threat from respondent nos. 4 and 5, take appropriate steps. Simultaneously, SHO, Police Station – Sitarganj, District – U.S. Nagar, is also
directed to call upon respondent nos. 4 and 5 and
